Appellate work is traditionally regarded as a risk-free area of practice. However, while appellate activities do not generate a significant number of all legal malpractice claims, lawyers performing appellate work bear a greater risk of becoming the subject of a malpractice claim than the claim data suggests. Appellate work presents risk to practitioners in that it is deadline-intensive, document-intensive and requires significant research, writing and oral advocacy skills.
