The CNA Lawyers Professional Liability Program has again broadened its policy form! The two biggest enhancements are:
  • Waiving 1/2 of the deductible up to $25,000 if a proper engagement letter was used for the matter in controversy
  • Up to $500,000 of claims expenses outside limits (CEOL) has been added to insured firms that focus 70% or greater of its time/billings in one area of practice other than wills, estates & trusts, or business transactions. To gain this extra CEOL the firm cannot dabble in estate planning or business transactions.

Specialization and engagement letter usage are two areas CNA feels strongly towards the safer practice of law. What are your views?

Wow. Those two LPL policy form enhancements offered by CNA, as noted in Dan McKennas blog, should be beneficial to lawyers and law firms seeking a competitive market for placing insurance coverage. The deductible waiver provision is a good incentive to promote proper scope of engagement letters. Nicely done!
